Acceptance of Terms

By accessing, browsing, or using the Clearcheck.app website or services, you acknowledge that you have read, understood, and agree to these Terms and Conditions, as well as our Privacy Policy. If you do not agree to these Terms and Conditions, you should not use this website or purchase our services.

Services Overview

Clearcheck.app provides digital background search reports generated from publicly available records and information obtained from third-party data providers. Reports are delivered electronically through our platform.

Clearcheck.app is a digital information service. It does not ship physical goods, and no tangible product is mailed or delivered.

Digital Service Acknowledgment

By purchasing a report through Clearcheck.app, you expressly acknowledge and agree that:

• You are purchasing an instant digital background search report.
• The report is generated after you submit the requested information.
• The report is delivered electronically through the website or platform.
• The service is deemed provided and fulfilled once the report is generated and made available to you.
• Results may vary based on the availability of public records and third-party source data.
• A report may contain records, limited information, or no results at all depending on available data.

Permissible Use of Reports (FCRA Notice)

The information in this report is derived from records that may or may not be in accordance with the Fair Credit Report Act (FCRA, Public Law 91-508, Title VI). This information may not be used for insurance, or credit evaluation and if used for employment purposes or in connection with other legitimate needs it is agreed that the information is for legitimate informational purposes only. The depth of information available varies. Final verification of an individual’s identity and proper use of report contents are the user’s responsibility.

Customer may be provided information that may constitute a Consumer report. Customer is an Individual or Business with legitimate needs for information that may be considered a consumer report and has a need for consumer information in connection with the evaluation of individuals for employment, promotion, reassignment or retention as an employee or other legitimate business purposes (“Consumer Report for Legitimate Purposes”), and has a permissible purpose for obtaining consumer reports, as defined by Section 604 of the Federal Fair Credit Reporting Act (15 USC 1681b) as amended by the Consumer Credit Reporting Reform Act of 1996, hereinafter called “FCRA”. The customer certifies their permissible purpose as: In connection with legitimate Business purposes involving the consumer. Customer certifies that it will request consumer reports pursuant to procedures prescribed by Customer from time to time only for the permissible purpose certified above, and will use the reports obtained for no other purpose. Customer will maintain copies of all written authorizations for a minimum of three (3) years from the date of inquiry. THE FCRA PROVIDES THAT ANY PERSON WHO KNOWINGLY AND WILLFULLY OBTAINS INFORMATION ON A CONSUMER FROM A CONSUMER REPORTING AGENCY UNDER FALSE PRETENSES SHALL BE FINED UNDER TITLE 18, OR IMPRISONED NOT MORE THAN TWO YEARS, OR BOTH. Customer shall use each consumer report only for a one-time use and shall hold the report in strict confidence, and not to disclose it to any third parties; provided, however, that Customer may, but is not required to, disclose the report to the subject of the report only in connection with an adverse action based on the report. Moreover, unless explicitly authorized in this Agreement or in a separate agreement, between Customer and Searched Person, for scores obtained from Any Source, or as explicitly otherwise authorized in advance and in writing by Clearcheck.app through Customer, Customer shall not disclose to consumers or any third party, any nor all such data provided under this Agreement, unless clearly required by law.

DISCLAIMER

Information provided through this service is subject to the following restrictions and/or limitations:

• Coverage and Content — Data may not be available from all states or all counties or all smaller subdivisions within. Some items of data may be available from some but not other jurisdictions, and many of the sources of court records have attempted to protect personal identifiers by no longer providing data fields containing Social Security numbers, dates of birth, addresses, or telephone numbers.
• History — Some jurisdictions provide deeper history than others, often due to the advent of computerized record keeping, which did not occur at the same time everywhere; consult the coverage chart for indications of historical availability in any particular jurisdiction.
• Correctness — Some jurisdictions provide more recent data than others, and some jurisdictions have ceased to make records available to the public; consult the coverage chart for indications of correctness in any particular jurisdiction. Results may include low-level crimes and Non-Conviction Traffic infractions. These may not constitute a criminal record but cannot be filtered due to the nature of the files and update files from the different state and local jurisdictions and may appear on the final report. Clearcheck.app is held harmless for any records that are non-criminal that appear in our reports.
• Reliability — The data provided through this service is a snapshot in time and may not reflect all action that has occurred since the electronic record of the reported event(s) was obtained.
• Accuracy — Data entry errors occur everywhere every day. Positive ID requires fingerprint search. Disposition inquiries should be directed to the reporting agency.
• Verification — Since records may not have sufficient information to establish an exact identity, search results should be taken only as an indicator of information available. Records are for informational purposes only.
• Completeness — Information provided through this service is from public court records, but does not comprise all information from the official court records available to the public. Court pleadings, for instance, may be found in case files that may be viewed and copied at a courthouse. Confidential cases, sealed cases, sealed documents, and expunged records also may not be available through our service.
• FCRA — You may not use our service or the information it provides to make decisions about consumer credit, employment involving consumer credit, insurance, or any other purposes that would require FCRA compliance.

Eligibility and User Responsibility

You agree to use Clearcheck.app only for lawful purposes and in compliance with all applicable local, state, federal, and international laws and regulations.

You are responsible for:

• Providing accurate information when requesting a search.
• Reviewing product descriptions and any sample materials before purchase.
• Determining whether the service meets your needs before submitting payment.
• Using report information responsibly and lawfully.

Sample Report and Product Understanding

Clearcheck.app may provide sample reports, previews, descriptions, FAQs, and explanatory content to help customers understand the nature and scope of the service before purchase. By completing a purchase, you acknowledge that you have had a reasonable opportunity to review the service description and understand the type of report being ordered.

You agree that dissatisfaction based solely on the format, scope, level of detail, or absence of records in a report does not mean the service was not delivered or was materially different from what was described.

Pricing and Payment

All prices are listed in U.S. dollars unless otherwise stated. Payment must be made in full at the time of purchase through our approved third-party payment processors. By submitting payment, you authorize Clearcheck.app and its payment processors to charge the applicable amount for the requested service.

No-Refund Policy for Digital Reports

Due to the nature of Clearcheck.app’s instant digital services, all sales are final once a search has been submitted and a report has been generated or delivered electronically. Each background search triggers real-time processing and data access costs, regardless of whether records are found. Because the service is performed and fulfilled upon report generation and delivery, Clearcheck.app does not provide refunds, returns, exchanges, or cancellations after processing begins. The sole exception to this policy is the Money Back Guarantee described below.

Refunds will not be issued based on:

• A customer’s change of mind after purchase.
• The absence of records or limited results in a report.
• A customer’s dissatisfaction with the amount of information returned.
• A customer’s failure to review the service description, FAQ, sample report, or these Terms and Conditions before purchase.
• A misunderstanding of the nature of an instant digital information service.
• Mistakes or inaccurate information provided by the customer on the order form, after the customer has confirmed the information submitted.

If Clearcheck.app determines, in its sole discretion, that a duplicate charge or technical billing error occurred, Clearcheck.app may review the matter and provide an appropriate remedy. If Clearcheck.app or its data providers are unable to generate a report at all for a submitted search, Clearcheck.app may, in its sole discretion, refund the purchase.

Money Back Guarantee

Clearcheck.app offers a limited Money Back Guarantee on criminal record searches. If a criminal record existed in a jurisdiction listed on our current coverage page at the time of your search, and that record was not returned in your report, Clearcheck.app will refund the purchase price for that specific search.

To request a refund under this guarantee, you must demonstrate that the record in question exists in a jurisdiction covered by Clearcheck.app at the time of purchase, as reflected on our published coverage page. Clearcheck.app will review the claim and, if verified, issue a full refund for that search.

This guarantee does not apply where:

• The record is not located because the jurisdiction is not included in Clearcheck.app’s published coverage.
• The record has been expunged by a judge or court order.
• The record is a juvenile record, or an arrest that did not result in a court action.

Customers are responsible for reviewing Clearcheck.app’s coverage page before purchasing a search. This guarantee is offered at Clearcheck.app’s discretion for the limited purpose described above and does not otherwise modify the No-Refund Policy.

Chargebacks and Payment Disputes

If you initiate a chargeback or payment dispute, Clearcheck.app reserves the right to provide relevant transaction and service-delivery evidence to the payment processor, card issuer, acquiring bank, or dispute resolution entity.

Such evidence may include, without limitation:

• Order and transaction records
• Purchase timestamps
• Report generation and delivery timestamps
• IP address or device-related usage information
• Access logs showing report availability or retrieval
• Service descriptions, FAQs, sample reports, and policy pages in effect at the time of purchase

Chargebacks or disputes determined to be fraudulent, or that result in theft of services, may be pursued under applicable law, including recovery of amounts owed and associated costs.

No Guarantee of Results

Clearcheck.app does not guarantee that a report will contain any minimum amount of data, specific records, or any particular result. The information returned depends on the quality, availability, and scope of public records and third-party data sources at the time of the search.

You acknowledge that a report showing no records, few records, or incomplete records does not mean the service failed or was not delivered.

Accuracy and Third-Party Data

Clearcheck.app relies in part on third-party data providers and public records sources. We do not control those sources and do not warrant that information obtained from them will always be complete, current, or error-free.

Clearcheck.app disclaims liability for inaccuracies, omissions, outdated records, or unavailable data originating from third-party providers or public record systems.

Criminal Records Coverage, Retention, and Search Criteria

Juvenile records (offenses committed before age 18) are not included in reports. Arrest records are generally only available where the arrest resulted in a court action. Coverage is limited to jurisdictions that make records available to Clearcheck.app’s data providers directly; customers should review current jurisdictional coverage before ordering a search.

Search results are valid for 30 days from the date of purchase, and an accessible copy of your results is retained for 30 days only. Results can be downloaded, printed, or emailed directly from the report; we recommend doing so within 30 days of purchase.

Criminal record searches are conducted using the name and date of birth submitted by the customer. Social Security numbers, if provided, are not used as criminal search criteria (SSNs were removed from criminal and public records under the Federal Privacy Act) and are used only where a report specifically verifies SSN validity through consumer records.

Driving History Report Disclaimer

By ordering a Driving History Report, you authorize Clearcheck.app to provide a report of the current driving record for the individual identified in your search. You certify that any driver’s license number or other identifying information you submit is your own, or that you are otherwise legally authorized to request that individual’s record. Requesting another person’s driving record without proper authorization may subject you to penalties under applicable federal and state law.

Clearcheck.app will not sell or disclose the information requested except to fulfill the report you’ve ordered, or as required by law.

Driving History Reports are sourced from state agencies and third-party service bureaus and are provided “as is.” Clearcheck.app does not warrant the accuracy or completeness of driving history information and is not responsible for damages arising from errors in customer-submitted information, duplicate requests, transmission errors, or processing delays.

By ordering a Driving History Report, you agree to comply with all applicable local, state, and federal laws regarding its use, and agree not to share the report with third parties or display it publicly.

National Wants and Warrants Check Disclaimer

Warrant information is issued and updated by thousands of individual agencies nationwide on a continuous basis. Results may not reflect the most current status — a warrant may already have been cleared by arrest, court appearance, vacated, recalled, or withdrawn, and new warrants may have been issued since the record was last updated.

Warrant information is sourced from public records provided by issuing agencies and should not be relied upon as grounds for arrest. It is intended for informational purposes only. Appearance of a name in results does not indicate guilt, and results may reflect data entry errors made at the source.

National Arrest History Check Disclaimer

Arrest records are reported continuously by thousands of individual agencies nationwide. Results may not reflect the most current status — an arrest may have been dropped, resulted in acquittal, been vacated, recalled, or withdrawn, and new arrests may have occurred since the record was last updated.

Arrest information is sourced from public records provided by issuing agencies and should not be relied upon as evidence of conviction. It is intended for informational purposes only. Appearance of a name in results does not indicate guilt, and results may reflect data entry errors made at the source.

Prohibited Use

You agree not to:

• Use the website or services for any unlawful, fraudulent, or abusive purpose.
• Misrepresent your identity or the purpose of your search.
• Interfere with the operation, security, or availability of the website.
• Copy, scrape, reproduce, or exploit the website or reports without authorization.
• Share, redistribute, or publicly display report contents obtained through Clearcheck.app.

Intellectual Property

All website content, branding, logos, text, graphics, layout, and software associated with Clearcheck.app are owned by or licensed to Clearcheck.app and are protected by applicable intellectual property laws.

You may not reproduce, distribute, modify, or create derivative works from Clearcheck.app content without prior written permission.

Disclaimer of Warranties

The website and services are provided on an “as is” and “as available” basis. Clearcheck.app makes no warranties, express or implied, regarding the operation of the website, the availability of services, or the completeness, reliability, or accuracy of report content.

Limitation of Liability

Clearcheck.app’s total liability for any claim arising from or related to the use of its services shall not exceed the amount actually paid by you for the specific report or service giving rise to the claim.

Indemnification

You agree to defend, indemnify, and hold harmless Clearcheck.app, its affiliates, service providers, officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including attorneys’ fees) arising out of or related to your use of the website or services, your violation of these Terms and Conditions, or your misuse of any report or information obtained through Clearcheck.app.

Privacy Policy

Your use of the website and services is also subject to the Clearcheck.app Privacy Policy, which explains how we collect, use, and protect personal information.

Changes to These Terms

Governing Law

These Terms and Conditions shall be governed by and construed in accordance with the laws of the applicable jurisdiction in which Clearcheck.app operates, without regard to conflict of law principles.
